1. Who we are

3 Wee Pages is run by Towpath Digital Ltd, a company registered in England and Wales, company number 16913912. Our registered office is Huntingdon Boathaven, The Avenue, Godmanchester, Huntingdon PE29 2AF. Email hello@3weepages.co.uk. We aren't registered for VAT.

"We" and "us" means Towpath Digital Ltd. "You" means the person or business ordering the site.

2. How the contract works

You build your site in our designer, check it and sign it off. On the pay step we show you the main points of the deal, you tick to agree to these terms and to the yearly renewal, and you choose whether we start straight away or wait until your 14 days are over (section 7). The contract starts when your payment goes through.

We then email you a confirmation with the main points of the deal, your dates and how to cancel. Please keep it. We keep a record of the version of these terms you agreed to, and you can ask us for a copy at any time. These terms are in English only.

If you spot a mistake before you pay, go back a step and change it; nothing is charged until you confirm on Stripe's payment page.

You may be buying for your business (as most of our customers are) or as a private individual, for example for a personal portfolio. Some parts of these terms only apply to private individuals, and we say where.

3. What you get

• A three-page website, built from your answers in our designer (or put together by us from your details, if you'd rather), and checked by a person before it goes live.
• If you chose a new web address: a .co.uk (or .uk) registered in your name (section 8).
• Hosting and the padlock (SSL) for as long as you pay for it.
• Two reviews a year by your Pal, the person at 3 Wee Pages who looks after your site (section 14).
• Changing your hours, services, wording and contact details yourself, from your account.

Your site goes live once a person has checked it. We don't promise a date, because some sites need a question answered first.

Three pages is the core of 3 Wee Pages. If you need more, we can quote for extra pages. They're optional, and you can always say no (section 10).

Email forwarding for your own web address (like hello@yourbusiness.co.uk to the inbox you already use) is coming soon and isn't switched on yet. When it is, it's included at no extra cost for addresses we registered for you, and section 9 says what happens to it if you leave.

4. What it costs

Our prices include everything we charge: no VAT is added, because Towpath Digital Ltd isn't registered for VAT. If that changes we'll tell you before it affects anything you pay.

5. Paying, and the yearly renewal

You pay by card on Stripe's secure payment page. We never see or store your card number.

The renewal is automatic. When you order, you agree that Stripe keeps your card on file so we can take £49 a year, starting a year after your first payment and every year after that, until you cancel. Stripe's payment page may call the first year a "free trial" of the renewal: it isn't a trial, it's the year your £149 already covers.

• We email you 30 days before each renewal, with the date, the amount and how to cancel.
• Cancel online at any time from your account (Billing, then Manage), or by emailing us. Cancelling stops the next renewal; your site stays live until the end of the year you've already paid for.
• We don't refund part of a year you've paid for, except as sections 6 and 7 say, or where the law gives you more (for example any cooling-off period after a renewal).
• If we ever change the renewal price, we'll tell you at least 30 days before it applies to you, and you can cancel before then.

If a renewal payment fails, Stripe tries again and emails you, and we'll get in touch too. See section 9 for what happens if it stays unpaid.

6. The 30-day refund

• Email hello@3weepages.co.uk or reply to your confirmation email. The 30 days count from the day your payment went through.
• We refund to the card you paid with, within 14 days of hearing from you.
• We end the yearly renewal and take your site down. If we registered a web address for you, it stays in your name and we release it so you can move it, at no extra charge.
• If you're a private individual cancelling within your 14 days, section 7 applies instead where it gives you more.

After 30 days the £149 isn't refunded, but you can stop the renewal at any time (section 5).

If we can't get your site right with you, or we decide not to go ahead (section 13), we refund all £149.

Referral codes. If you use a referral code, you pay £149 and we pay £25 back to the card you paid with once your 30-day refund period has ended. If we refund you within those 30 days, the £25 isn't paid.

7. Your 14-day right to cancel (private individuals)

If you're buying as a private individual, mainly for purposes outside your trade, business, craft or profession, the law (the Consumer Contracts Regulations 2013) gives you 14 days from the day your payment goes through to cancel, without giving a reason. If you're buying for your business, this section doesn't apply, but the 30-day refund in section 6 does.

On the pay step you choose one of these, and your confirmation email says which:

• Wait until the 14 days are over. We don't start work or register your web address until then. If you cancel within the 14 days, you get all £149 back.
• Start straight away. You ask us to start within the 14 days. If you then cancel within them, you pay for the work done up to when you told us, and we refund the rest. That amount is worked out fairly for what we'd done (for example checking your site or registering your web address), and we never keep more than £50, so you always get at least £99 back.

How to cancel: tell us clearly that you want to cancel, by email to hello@3weepages.co.uk or by post to the address in section 1. You can use the form below (it's also in your confirmation email), but you don't have to. It's enough to send your message before the 14 days end. We refund you within 14 days of hearing from you, to the card you paid with, and there's no fee for refunding.

Each extra piece of work you agree to later (section 10) is a new contract with its own 14 days, and we'll ask you the same question about starting straight away.

8. Your web address

• We register .co.uk and .uk addresses through Namecheap, a registrar accredited by Nominet (the .uk registry), as their reseller. The address sits in our Namecheap account so we can look after its settings and renew it for you while you're a customer.
• To register it we give Nominet and Namecheap your name, address, email and phone number, so these must be real and up to date (section 12). We won't register it with missing or made-up details.
• As the registrant you're bound by Nominet's terms and conditions of domain name registration.
• If you already have a web address, it stays with whoever it's registered with now, and we just point it at your site.

9. Cancelling, lapsing and leaving

If you cancel the renewal

Your site stays live until the end of the year you've paid for. Before then, ask us to release your web address (£25) and move it wherever you like. When that year ends, your order ends and your web address goes where “When your order ends” below says. We don't renew it after that: renewing it is then between you and your new registrar, or Nominet.

If a renewal payment fails

Stripe retries and we email you. If it's still unpaid 30 days after the renewal date, we take your site offline, and if it stays unpaid your order ends as “When your order ends” below says. Pay within that time and we put everything back.

When your order ends

If your order ends for any reason, your web address stays yours. Tell us the IPS tag of the company you'd like it moved to and we'll move it within one working day. If you don't tell us within 30 days, we release it to Nominet, the .uk registry, where it stays in your name. Moving it is included if you cancel within 30 days of paying; after that it's £25.

Leaving and moving your web address

At any time and for any reason, it's £25 to release your web address: we change its IPS tag (the registrar tag Nominet uses to move a .uk address) to the one your new registrar gives you, and it moves to them. We'll help you point it at your new site. We won't hold your address back or drag out the move. There's no £25 when we release it because of the 30-day refund (section 6), your 14-day cancellation (section 7) or because we stop offering 3 Wee Pages (section 17).

Email forwarding, when it's switched on

Forwarding runs on our registrar's settings for your address, so it stops when your address moves to another registrar or its settings are changed, and when the address lapses. Set up email wherever you take it before you move.

Your site

If you leave after your first 30 days, you can ask us for a copy of your site (section 11). When it comes down, we keep your order and site content for 12 months after you leave so we can help if you come back, then delete it, as our privacy policy says.

10. Add-ons and extra work

• Add-ons (listed on our add-ons page) aren't on sale yet. When one is, we'll show its price, how it's billed and how to stop it before you buy, and you'll agree to it separately.
• Extra pages and bigger work (new copy, new photos, restructuring) are optional. We quote first in writing. Nothing is done or charged until you say yes.
• Once you agree, we send an invoice from Stripe with a link to pay by card. Payment is due within the time shown on the invoice (usually 14 days). No VAT is added.
• Small fixes (a phone number, a price, a typo) we do for free.

11. Your website and your content

Your content is yours. The words, photos, logo and details you give us stay yours. You let us use them to build, host and look after your site, and to show your site to your customers. We won't show your site to anyone as an example of our work unless you've said yes to that.

A copy of your site when you leave. We host your site; we don't offer downloads. If you leave after your first 30 days (once no refund can be taken), ask us and we'll send you a copy of your site. We give you a permanent, non-exclusive licence to use the design and layout in that copy for your own business, wherever you host it. Our designer, our hosting and the software behind the platform stay ours: "yours" means your web address, your content and, when you leave, a copy of your site, not our software.

If someone tells us something on your site breaks the law or their rights, we may ask you about it and, if we need to, take that part down while we sort it out. You can report a problem with any site we host by emailing hello@3weepages.co.uk.

12. What we need from you

• Accurate details. Your name, address, email and phone must be real, because Nominet needs a genuine registrant. Tell us if they change. False details can cost you your web address.
• The right to use your content. Any logo, photo or text you give us must be yours to use.
• True claims. What your site says about you, including qualifications, memberships, insurance and guarantees, must be true. We check anything customers rely on before it goes live, but that's a check, not a promise that it's right.
• Timely replies. If the person checking your site has a question, it can only go live once we have your answer.

13. What we won't do

We don't design logos. We won't build or host a site for anything illegal, sexually explicit, designed to deceive people, or that stirs up hatred against people for who they are. If we decline an order for that reason before your site goes live, we refund you in full. If a live site is used for those things, we may take it offline and will tell you why.

14. Changes, reviews and support

You can change your opening hours, services, wording and contact details yourself, from your account, at no charge.

Two reviews a year are included, from your first year. Your Pal looks over your live site, checks your details and your search listing are still right, and then fixes what's wrong or tells you what to change. Ask for a review from your account at any time, or ask your Pal to book them in.

We reply to messages within one working day, Monday to Friday.

15. Keeping your site up

We host your site with Cloudflare in front, and aim to keep it up all the time. Nobody can honestly promise 100% uptime, so we don't. We'll put things right as quickly as we reasonably can when something goes wrong.

16. If something goes wrong

For everyone: we'll provide the service with reasonable care and skill. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit.

If you're buying for your business: we're not responsible for lost profits, lost business, lost data or other indirect losses. Our total responsibility to you for anything else is limited to what you've paid us in the 12 months before the problem happened.

If you're buying as a private individual: you have legal rights under the Consumer Rights Act 2015, and nothing in these terms takes them away. If we don't provide the service with reasonable care and skill, you can ask us to put it right or, if we can't, to refund some or all of what you paid. We're responsible for loss you suffer that was a foreseeable result of us breaking these terms or not using reasonable care and skill, but not for loss that wasn't foreseeable. We supply the service for your own use; we're not responsible to you for business losses.

17. If we stop offering this

You keep your web address. If we ever stop offering 3 Wee Pages, we'll give you at least 3 months' notice, stop taking renewals, release your web address at no charge, and help you move your site. If you've paid for a year that we won't finish, we'll refund the part we don't provide.

18. Complaints

If you're unhappy, email hello@3weepages.co.uk. A person replies within one working day, Monday to Friday, and we'll tell you what we'll do and when.

19. The law that applies

These terms are governed by the law of England and Wales. If you're a business, the courts of England and Wales deal with any dispute. If you're a private individual, you can also bring a claim in the courts of Scotland or Northern Ireland if you live there.

20. Changes to these terms

If we change these terms, we'll put the new version here with a new version number. For your renewal we'll email you about any important change at least 30 days before it applies to you, and you can cancel before then. Your order stays on the version you agreed to until your next renewal.
